Palmer by the discharge of a loaded pistol claimed to be the result of certain alleged negligence and carelessness of appellant in reference to the manufacture by it and its failure to properly test a certain S & W 38-caliber gun which plaintiffs in that action purchased from a sporting goods shop in Orange County on September 28, 1953.
